M Group, Inc. Limited Warranty

Limited Warranty:  M Group, Inc. ("Seller") warrants to the distributor that Seller's products (the "Products") will be free from material defects in workmanship and materials under normal use and service for a period of one year from the date of Seller's delivery of the Products to the distributor (the "Warranty Period").  There is NO WARRANTY in cases of damage in transit, negligence, abuse, abnormal usage, misuse, accidents, normal wear and tear, damage due to environmental or natural elements, failure to follow Seller's instructions or improper installation, storage or maintenance.  

Remedy:  Seller's sole and exclusive obligation under this warranty (and the distributor's sole and exclusive remedy) shall be, upon prompt written notice by the distributor during the Warranty Period of any breach, to either, at Seller's option, replace without charge, F.O.B. Seller's facility, any Product found by Seller to be covered by and in breach of this warranty or credit to the distributor the purchase price paid for such Product (which credit may be applied to the purchase of Products).   

Notice of any warranty claim or request for warranty service should be sent to Seller  at the following address:  Meteor, a division of M Group, Inc., 1860 Renaissance Blvd., Sturtevant, Wisconsin 53177, Attention:  Alan.  

Any assistance Seller provides to or procures for the distributor outside the terms, limitations or exclusions of this warranty will not constitute a waiver of the terms, limitations or exclusions of this warranty, nor will such assistance extend or revive the warranty.  Seller will not reimburse the distributor for any expenses incurred in repairing or replacing any defective Products, except for those incurred with Seller's prior written permission.  

This warranty gives the distributor specific legal rights, and the distributor may also have other rights which vary from state to state.   

Disclaimer Of Other Warranties:  THE EXPRESS WARRANTIES DESCRIBED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS WARRANTIES.  SELLER HEREBY DISCLAIMS AND EXCLUDES ALL OTHER EXPRESS WARRANTIES.  FOR COMMERCIAL PRODUCTS, SELLER DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  FOR CONSUMER PRODUCTS, THE DURATION OF ANY IMPLIED WARRANTIES (INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) RELATING TO THE PRODUCTS SHALL BE LIMITED TO THE WARRANTY PERIOD.  Some states do not allow limitations on how long an implied warranty lasts, so the limitation in the preceding sentence may not apply.  Any oral or written description of the Products is for the sole purpose of identifying the Products and is not an express warranty.  Seller has no post–sale duty to warn the distributor or any other party about any matter.  

Limitation On Damages:  SELLER SHALL NOT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES.  SELLER'S AGGREGATE LIABILITY WITH RESPECT TO ANY PRODUCT AND THIS CONTRACT SHALL BE LIMITED TO THE MONIES RECEIVED BY SELLER FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.  Some states do not allow the exclusion or limitation of incidental and consequential damages, so the above limitation or exclusion may not apply.
